Welcome to the Captured by Catherine website. Please read through these terms and conditions carefully before placing your order. By using this website and/or placing an order you agree to be bound by the terms and conditions set out below. Please also read our privacy statement regarding personal information provided by you. We may change these terms from time to time without notice to you.
When buying through the website, the contract only becomes legally binding once we have dispatched the order. You need to be over 18 (the age to contract legally) to use this site.
The processing of your payment and acknowledgment of your order does not constitute legal acceptance of your order.
We reserve the right to cancel any orders before they are dispatched. In these cases, we will inform you as soon as we can, advise the reason and issue a full refund.
Accuracy of Content
Every care has been taken in the preparation of the content of this website, to ensure that the details, descriptions and prices quoted are correct at the time of publishing. All measurements given are approximate.
We will not be held responsible for any errors or omissions or for consequences arising from the use of the information.
All goods are sold subject to availability. We will inform you as soon as possible if the goods you have ordered are not available for any reason.
Prices and payment
Full payment will be taken with your order. The total cost of your order is the price of the products ordered and delivery charges as set out in the delivery options section of this website. You may pay using credit or debit cards. All credit/debit cardholders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses or does not, for any reason, authorise payment to us, whether in advance or after a payment, we will not be liable for any delay or non-delivery.
All prices are shown in UK Pounds (£) Sterling and you will be billed in this currency.
Credit Card Security
The Captured by Catherine website uses SSL (secure socket layers) protection system, which is the industry standard. The delivery timescales quoted are indicative only. While we use only reputable delivery companies such as Royal Mail, we do not accept any liability for delayed delivery caused by any third party. Your parcel will only be considered missing if it fails to arrive 7 working days after the approximate delivery time indicated.
During the checkout process you will be advised of the delivery charge, unless we are unable to automatically calculate it (for example outside the UK Mainland). If this happens we will inform you of the cost via e-mail or telephone and await your approval before we proceed with the order. We reserve the right to update any shipping charges, although you will be asked to confirm via email or telephone if any changes occur before you are billed. If you would like us to calculate international shipping charges for you prior to ordering, please e-mail email@example.com.
Please note that one offer may not be used in conjunction with any other offer. Once an offer has expired it will be no longer be possible to take advantage of that offer.
Cancellation by you:
Under the Consumer Contracts Regulations, if you buy online or by phone, consumer rights entitle you to a full refund if you request one in writing within 28 calendar days of receipt. We are sorry but personalised products, food and personal products such as earrings, cannot be refunded or exchanged unless faulty.
If cancelling your contract, please complete the returns form in the parcel and package the goods appropriately to ensure that they are returned in perfect condition. We recommend you request a Proof of Postage certificate (free) from the Post Office if you return your goods.
Any sum debited from your credit card will be credited to your account as soon as possible, and in any event within 30 days of your order, only once the goods have been returned by you and received by us in the condition they were in when delivered to you. If the goods are not received in good condition, we reserve the right not to refund or to deduct the direct costs of recovering the goods from the amount to be credited to you.
We will only refund the cost of postage to return an item if you have been sent incorrect, faulty or damaged goods.

Cancellation by us:
We reserve the right to cancel the contract between you and us if we have insufficient stock to deliver the goods you have ordered, we do not deliver to your area or one or more items was listed at an incorrect price due to human error. If we do cancel your contract, we will notify you and will re-credit to your account any sum deducted from your credit card as soon as possible. We will not be obliged to offer any additional compensation for disappointment or inconvenience suffered.
Limitation of Liability
If the products we deliver are not what you ordered, are damaged or faulty, or the incorrect quantity is delivered, we will have no liability to you unless you notify us by email of the problem within 7 working days of the delivery.
If you do not receive the products ordered within 7 working days of the approximate delivery date initially provided, we shall have no liability to you unless you notify us by email of the problem within 14 working days of the approximate delivery date. If you notify us of a problem under this condition, our only obligation will be, at your option either
- To make good any shortage or non-delivery
- To replace any goods that are damaged or faulty
- To refund the amount paid by you for the goods in question
We will not be held liable to you for any indirect or consequential loss, damage or expenses arising out of any problem you notify us of under this condition and will have no liability to pay you any money by way of compensation.
We cannot be held responsible for any delays once the goods have left us and are in possession of the delivery carrier or post office.
Customer Reviews and Feedback
If you send reviews, feedback or specific submissions (for example competition entries) with or without a request from us, you agree that we may edit, copy or publish them in any medium. All feedback and reviews submitted to the site are the property of Catherine Mason (Captured by Catherine).
All transactions are deemed to be completed within the United Kingdom and as such are governed and interpreted by English Law.
